Welcome to Nirban. By accessing our website, mobile application, or booking a session (Counselling or Active Listening), you agree to comply with and be bound by the following Terms and Conditions.

If you do not agree to these terms, please refrain from using our services.

1. Nature of Service

Nirban is a digital platform connecting individuals with:

• Professional Psychologists: For clinical counselling and therapy.
• Trained Active Listeners: For empathetic, non-judgmental emotional support (non-clinical).

While we strive to support your mental wellbeing, our services are not a substitute for emergency medical care.

2. Eligibility & Account Security

• Age Requirement: You must be at least 18 years old to use our services independently. Users under 18 must have explicit consent from a parent or legal guardian.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Nirban immediately of any unauthorized use of your account.
• Accuracy: You agree to provide accurate, current, and complete information during registration and booking.

3. Code of Conduct

To maintain a safe environment for both clients and professionals, you agree NOT to:

• Harass, threaten, or abuse any counsellor, listener, or Nirban staff member.
• Engage in sexual misconduct or inappropriate behavior during sessions.
• Record sessions (audio or video) without explicit written permission from Nirban.
• Use the platform for any illegal purpose under the laws of Bangladesh.

Consequence: Violation of this code will result in immediate termination of the session without refund and a permanent ban from the platform.

4. Payments & Refunds

All payments must be made in advance through our designated payment gateways. By booking, you acknowledge our Refund & Cancellation Policy:

• Cancellation: Must be done at least 24 hours in advance for a full refund.
• Rescheduling: Allowed once, free of charge, if requested 24 hours prior.
• No-Shows: If you are more than 20 minutes late, the session is forfeited with no refund.
• Platform Failures: We provide full refunds or rescheduling for technical issues on our end.

5. Privacy & Confidentiality

Your privacy is paramount. We adhere to strict data protection standards as outlined in our Privacy Policy.

• Session content is confidential between you and the professional.
• Exceptions to confidentiality exist only if there is a legal obligation or an immediate risk of harm to yourself or others.
• We do not sell your personal data to third parties.

6. Intellectual Property

All content on the Nirban platform—including text, graphics, logos, software, and psychological tools—is the property of Nirban. You may not reproduce, distribute, or create derivative works from our content without express written permission.

7. Limitation of Liability

Nirban connects you with professionals but is not directly liable for the medical outcome of counseling.

• We are not liable for outcomes resulting from your failure to provide accurate information to the professional.
• We are not liable for interruptions caused by "Force Majeure" events (e.g., nationwide internet outages, natural disasters).

8. Changes to Terms

Nirban reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. Significant changes will be notified via email or app alerts.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangladesh.
